RULES GOVERNING THE BARBARA RIHL PHOTO CONTEST
Article 1 – The Sponsor
Barbara Rihl, SARL (hereinafter referred to as "the Sponsor") – a limited liability
company with capital of EUR 138,600, registered with the Register of Commerce and
Companies of Paris (No. 424 537 769) and with its registered office at 33 rue de
Miromesnil 75008 Paris, France – is organizing a contest entitled "Barbara Rihl
Around the World" (hereinafter "the Contest") from March 3, 2014 to March 24, 2014.
No purchase necessary to enter or win.
Article 2 – Conditions of participation
The Contest is open to persons over 18 years of age residing in France or other
countries. It shall be open solely during the period specified in Article 1. Entry in the
Contest constitutes acceptance of all of the present rules (hereinafter "the Rules")
are governed by French law.
The contestant must have access to the Internet, a valid electronic address and an
account on the Facebook social network.
The Sponsor reserves the right to disqualify persons that do not comply with the
Rules, are unable to show sufficient proof of their age or place of residence, enter the
contest under more than one identity or supply false information.
Article 3 – How the Contest works
The contest will take place exclusively on the Sponsor's Facebook page
The Contest will take the form of a photography competition. Entrants are asked to
watch the Barbara Rihl Around the World 2014 video on Youtube, then submit a
photograph (only one photo per entrant) that they have taken of themselves with
their Barbara Rihl brand handbag or of their handbag by itself in a place of their
choice. All entries should be sent to the following e-mail address:
firstname.lastname@example.org. No entry submission e-mail sent to any other electronic
address will be taken into consideration.
In their entry submission e-mail, contestants should indicate the following: last name
– first name – birth date – address – e-mail address – choice of handbag color.
Photographs may be submitted from March 3, 2014 to March 24, 2014.
The designer Barbara Rihl herself will select the five best photographs on the basis of
their originality and creativity as well as aesthetic considerations.
The five contestants whose photographs are selected will be notified by e-mail at the
address indicated in their entry submission e-mail.
The five photographs described will then be posted in a special Contest photo album
on the Sponsor's Facebook page from March 1, 2014 to April 8, 2014. Fans will be
encouraged to vote for the ones they "like." At the end of this period, the entrant
whose photo receives the most votes will be designated as the final winner of the
The final winner will be notified by email at the electronic address indicated in their
entry submission e-mail.
Article 4 – Prizes
The final winner of the Contest will receive a Barbara Rihl handbag that has been
personalized exclusively for the occasion with the winner's name. The winner chooses
the color (orange, white, black, pink, beige, yellow, sky blue, red and turquoise). The
handbag – currently designated as "Natalia in Venice Beach" – is worth EUR 405.00.
The "Natalia in Venice Beach" will be rechristened using the first name indicated in
the final winner's entry submission e-mail.
The "Natalia in Venice Beach" handbag will be mailed to the final winner at the postal
address indicated in the entry submission e-mail within three weeks of the
announcement of the Contest winner (this period is not contractual and given for
informational purposes only).
In addition, the final winner will receive a special discount code, valid for one
purchase only. It will entitle the winner to 50% off any order of one or more items
from Barbara Rihl's online boutique: www.barbararihl.com.
The four other finalists will also receive a special discount code, valid for one
purchase only. It will entitle each finalist to 40% off any order of one or more items
from Barbara Rihl's online boutique: www.barbararihl.com. The special discount code
will be communicated by e-mail to the electronic address indicated in their entry
submission e-mail within three weeks of the announcement of the final winner.
Article 5 – Authorizations
The Contestants authorize Barbara Rihl to use, free of charge, the photographs sent
to the e-mail address email@example.com. They also authorize the Sponsor to
publish said photographs on its Facebook page and to use them in print and digital
formats for advertising and commercial purposes.
The Contestants must certify that the photographs submitted were taken by them,
are free of rights and do not infringe upon the rights of any party whatsoever.
The final winner authorizes the Sponsor to use the first name indicated in that
person's entry submission e-mail without any payment or consideration whatsoever.
The Sponsor reserves the right to automatically include all contestants in its
customer database for the purpose of sending them newsletters.
Article 6 – Amendments to the Rules
The Sponsor reserves itself the right to amend all or any part of the Rules described
without notice. Notice of any amendment to the Rules will be posted on the
Sponsor's Facebook page.
Article 7 – Disclaimer
The Sponsor may not be held responsible for any malfunction affecting the
Facebook page used to hold the Contest or, more generally, any malfunction relative
to the Internet.
If any third party makes an adverse claim as to any right in a photograph submitted
by a contestant and governed by Article 5 of these Rules, the Sponsor reserves all
rights, including legal recourse, against said contestant.
Article 8 – Disputes
The Cour d'Appel de Paris shall have exclusive jurisdiction as to any dispute between
the parties with respect to this agreement.
